Terms of Use
These terms cover your use of Hat Trick at hat-trick.app, a service run by Cascadia Digital Inc. ("we", "us"). By creating an account or using Hat Trick, you agree to them. If you don't agree, please don't use the service.
Accounts
- You can create an account yourself, or by accepting an invitation from a group.
- You must be at least 13 to have an account, or older if the law where you live sets a higher minimum age for using services like this one. If you're under the age of majority where you live, use Hat Trick with the permission of a parent or guardian, who agrees to these terms on your behalf.
- Younger children shouldn't create their own account. A parent or guardian can take part in the exchange on their behalf.
- Keep your sign-in details to yourself. Sign-in links in our emails log you straight in, so don't forward them. You're responsible for what happens under your account.
- Give us accurate information, and only invite people who'd expect to hear from you.
Groups, organizers and the draw
- Each group has an owner and may have organizers. They can invite and remove members, create events, and run the draw.
- Pairings are hidden from everyone, including organizers. An organizer can deliberately open the pairings to fix a problem, and we ask them to do that only when it's needed.
- The draw is random within the group's rules (for example, partners don't draw each other and nobody repeats last year's match). We can't promise every combination is possible; if a draw can't be made, Hat Trick will say so.
Your content
- You own what you write: wish lists, messages and posts. You give us permission to store it and show it to the people it's meant for, only to run Hat Trick.
- Anonymous messages hide your identity from the other person in the app. They aren't a way to get around these terms: be kind, and don't use them to harass anyone.
- Don't post anything unlawful, hateful, or harassing, anything that infringes someone else's rights, or malware or spam.
Acceptable use
Don't try to discover pairings you aren't meant to see, access other groups' information, break or overload the service, or use it to send unsolicited email. We may suspend or remove accounts or content that break these terms.
Gifts and spending
Hat Trick helps you organize a gift exchange. It doesn't sell, buy or ship gifts, and spend limits are guidance set by your group. Any purchase you make through a link on a wish list is between you and that seller.
Plans
- Free: anyone can take part in exchanges for free. An organizer on the free plan can run one group, with events of up to 8 people.
- Pro: a pass that lasts one year from purchase, bought with a single payment. It lets the organizer who buys it run up to 5 groups, with events of any size. Pro belongs to that organizer and covers the groups they own; the people in those groups don't need it.
- No automatic renewal: Pro never renews or charges you again by itself. Buying another year before your pass ends adds the year on after the current end date. We may email you shortly before it ends, and once a year after it has ended; you can turn these reminders off in Settings.
- When Pro ends: your groups go back to the free plan. Nothing is deleted. Events that already have more than 8 people keep everyone, but can't add more, and you can't start new groups beyond the free plan's limit.
- We may give Pro at no charge at our discretion. Prices shown are for new purchases, and we may change them; a pass you've already bought keeps what it included.
Payments
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders: it processes your payment, charges and remits any sales tax, VAT or GST, and issues your receipt. Your purchase is also subject to Paddle's buyer terms. Prices are shown in your local currency where available; taxes are added or included at checkout depending on where you live.
Refunds
You can get a full refund within 14 days of buying Pro, no questions asked. Our Refund Policy explains how to ask and what happens next.
Ending your account
You can delete your account at any time from Settings → Profile. We may close accounts that break these terms or that are inactive for a long time, and we'll try to give notice first when we reasonably can.
The service
We work hard to keep Hat Trick running and your information safe, but the service is provided "as is", without warranties of any kind. To the extent the law allows, Cascadia Digital Inc. isn't liable for indirect or consequential losses, or for anything beyond the amount you've paid for Hat Trick in the past twelve months. Some places don't allow these limits, so they may not all apply to you.
Changes
We may update these terms. If a change is significant, we'll let you know by email or in the app before it takes effect. Continuing to use Hat Trick after that means you accept the updated terms.
Governing law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. Any dispute will be handled by the courts of British Columbia.
